If what is saying is right, and I assume he knows his job!!! Shouldn't it be marked as such on your deeds? And if it isn't can you contest it? It is of course a money spinner for the council given that planning permission costs!!! Have you checked with you solicitor or is it too specialized?

I have told the solicitor.... took me ages to type it all out, lol so she will have gone home by now... I have been onto the Planning Portal... and it is almost certainly to do with the fact that it is open plan... but that shouldn't preclude the planting of flowers and stuff.... I want to put some of the veggies needing more light there, as well.... I mean, we are being told to be greener, and I ruddy well am not planting my veg or fruit where anyone can just walk over and take their pick... and that is exactly what will happen if it isn't fenced off.

Oh well, I've calmed down now.... but I shall modify things in the application so that I know it will be more acceptable.

And then self seed some blackthorn, lol!

There is absolutely nothing on the deeds to prevent it.... nothing at all... we have scoured through them, us and the solicitor, and she has also got the original deeds from when Westbury applied for planning permission to build the house.... nothing to stop us putting up fencing, or putting in borders/shrubs/trees etc. There is a clause which states that certain areas, coloured blue on the plans, are not the property of anyone, the local authority will maintain them, and no-one is allowed to build or obstruct them in any way.... but that doesn't apply to my bit, lol! I am very puzzled, and really feel that a mistake has been made. xxxx

MrDaff Report 9 Oct 2009 17:35

Dizzi, lol..... I know..... actually, he has put barbed wire along the back of his fence, and extended it to mine as well.... he refused to remove it, so R did that!

Actually R was talking of getting that real nasty razor wire that they use around defence places sometimes, lol

Ann.... he wouldn't be bothered by that... he is a *if it grows wild, let it grow free* sort of bloke.... his brambles are trailing over my side again... If I cut them back, he glares at me... he used to come and try to stop me, but doesn't anymore.... oh, and he used to think he could walk around my garden and pick the berries overhanging my side, lolol... including the ones out my back!! Nowhere near his house, lolol xxx

*glumly* I'd love it, Dizzi.... but would still have to get flaming planning permission, lolol!! ;¬))

Yep, Ann, you're right of course.... a silver lining to that little cloud then!!

I was soooo looking forward to the hunky landscaper being around again, lol!!

Still...... if it's worthwhile, it's worth waiting for, lol
