Why aren't the insurance company in contact with hers? Was her car not damaged and so she is not making a claim? Or not making a claim for personal details? Or she has not informed them? Jay

Lou you need to actually go in to the police station (if you can find one lol) and make a formal report - they should then tie it up with your calls to them last night. That should help you. Perhaps you could knock on a few doors of houses that overlook the corner where you were hit - maybe someone DID see something and would be willing to stand up for you? Maz. XX

I dont know if she is saying she had a witness.. All i know is that my company who should be paying the $250 have just rung to say they cant as she is not excepting liability....??? I reported it to the police at the time..In fact i rang them twice..But they said they wernt going to attend the scene and to just exchange details!!! (what DO i pay my tax's for???) Report this to the police NOW, as you went to the hospital. Unless the law has changed, it is an offence NOT to report an accident involving injury to a person WITHIN 24 hours. She presumably has not reported it. Okay, she is telling her insurance co she has a witness, family members are usually discounted because they are not considered impartial - you also have a witness, your sister. Jay

There will be no 50/50 here, let me tell you, lol... I will find a witness if it kills me..There is NO way she's getting away with that!!! I have been told i have to pay £250 excess on my car for repairs but fortunatly have 'legal cover', who will recover all my costs from the witch that hit us...Am thinking my shoulder is feeling worse now...I may even get whiplash over night..If she wants to play dirty.......!!! Lou, this sounds like its going to end up 50/50 unless you have any witnesses. Something similar happened to my son and he had to pay for his own car repairs ending up losing his no claims bonus, and it wasn't his fault. The other driver claimed liability at the time, but denied it later. Sue

Been on the phone to my insurance and the F****** bleep is not claiming liability!!!!!!!!!!!!!!!!!! I was stopped, indicating, and had handbrake on!!!! She, excelerated out of a road, into oncoming traffic and straight into the side of my car...How the F can she say it's NOT her fault......!????? Sorry you have had this happen to you, of course the Police should have come out especially as there were difficulties getting the details. I think you should make a complaint at the Police Station in the morning and explain what happened, certainly write everything down before you get hazy on the details, so that you have everything in writing and take a copy to the cop shop too.Good luck, hope you aren't feeling too sore tomorrow and the children aren't too upset. Lou, make sure you report it fully to the Ole Bill and get a crime report number (or whatever it is called) for your insurance company. Yes they should have come out if someone was injured and yes get pictures of injuries and something from the hospital and your GP. Glad you are ok, bet you were livid - well done for not smacking her one though! Maz. XX

Thanks all.. Not that bothered about the car, i'm not too bad, in fact in fine( i've had worse 'smacks' at kickboxing, lol)..Just shaken when i realised how close it was to my 4 year old.. If it had hit a few centimetres towards the back she would have been seriously injured or worse... The door is completly caved in and wouldnt open, i had to kick it and slide out... Wouldnt wish that on anyone.. Realising that in that split second my daughter could have gone forever...So angry at the STOOPID girl.. LOU XXXXXXXXXXXXXX Yes Sue, thats the one..Right under the street light aswell.Neither way was clear, thats why i had stopped!!! I thought she'd been drinking and said that to the girls mother, she said ''oh yeah, well the pubs shut so how could she be'...I replied that she must just be thick then to pull out into oncoming traffic into the side of a stationary vehical...I'm not sure if she was insured, or if she is on the mothers insurance..??? Time will tell..

Lou, Know which road it is,the main road outside the White Swan is well lit so she can't have had her mind on what she was doing. Just wondered if she shouldn't have been driving,she may not have a full licence. Big Hugs SueXXXXXXXXXX

When I retired from the police 4 years ago I worked for a solicitor involved with civil litigation for 3 years. My advice is to go and see your solicitor as soon as poss for advice. If you have visable bruising they will take some photos for evidence before they fade. Depending on your income you may qualify for legal assistance. Don't leave it - do it. x
