I'm with you Jim - can't see what the fuss is about. If she wants to sunbathe naked in her own backgarden good for her and anyone else who feels like it. The question should be raised as to why would someone tape it! He'll probably use some lame excuse like twitching. If I was his wife I'd be more worried about his behaviour than the neighbours.

If I walked down the road and saw a naked woman through her window I could be arrested as a Peeping Tom. If a woman walked down the road and saw a naked me through my window I could be arrested for indecent exposure. What is all the fuss about? Surely there is nothing dirty or rude about the human body.

Hi Christine, I can see the point with them arresting someone striding naked up the road, as some might be offended and it's a public space. Gwynne

Harry

Harry Report 25 May 2006 13:05

Gwynne, Pretty much correct. But 'intent' is always the stumbling block. How do you prove what was in the nudists mind.? courts generally don,t side with men over indecent exposure. Paul, waggling your bits about USUALLY proves intent, but it is not as black and white as you suggest. Many thanks. Happy days

Poolmaster Report 25 May 2006 13:03

there's a big difference. indecent exposure is waggling your bits in public at people in a place where that sort of thing doesnt usually occur. nude sunbathing in ones own garden is exactly that. if the neighbours didnt like it they shouldnt be looking! if kids could see or something then i accept to have a word with the lady, but taping her? bit far i think.

Cherry Report 25 May 2006 13:01

Hi Harry, I started nude sunbathing at a very early age and I've got the pictures to prove it. VE Day 1945 aged 6 months, posing charmingly on a sheepskin rug in my parents' garden with the Union Flag flying proudly on the flagpole in the orchard. Cherry

Guinevere Report 25 May 2006 12:59

The neighbours do seem to have got themselves in a fine old state about it and it was certainly a waste of public money to prosecute. I thought indecent exposure only applied when the intent was to outrage or upset. I'm not sure being nude in your own garden qualifies. I don't know how sheltered her garden was, I wouldn't sunbathe nude in ours. I wonder why the neighbours didn't 'have a word' before going to the police, it seems a bit weird to video her secretly. Christine, I have been retired from the police for 21 years. That was the case then. Still is? AL that was my earlier point. she would restrict my right to look out on to my garden for fear..... Happy days

I think you should be entitled to do what you want in your own home. If you plan to go naked in the garden you should ensure there is some sort of screening, so as not to offend others. Did it say how he saw her? Ie was he looking out of a bedroom window (in which case he didn't have to look!). AL

You are right there, Harry. Last year he had a female companion, she received lighter sentences but that's probably because of his prior record. Always going to get the idiots, but why flaunt it especially if you HAVEN'T got it.

i used to sunbathe noody in my garden, then one day a gorgeous blonde swedish girl moved in next door and started doing the same in her garden!! after a couple of days i noticed a hole in the fence. i was about to patch it up but i thought, 'nah, let her look!' lol!

Harry Report 25 May 2006 12:53

Ann, You make a valid point, but I think there is embarrassment when a couple are together. One, in some cases, doesn,t want to appear to be ogling the private parts of a statue of the opposite[ gender.(or even page 3 of the Sun) As an aside. isn,t there a pub where there is a statue of a male scotsman wearing only a sporran. If any lady lifts up the sporran, a bell rings in the adjoining bar, and everyone runs in to embarrass the lady. XXXPaul - boom, boom.XXXX Happy days

Are people going to become traumatised by all those nude statues in museums and public gardens? Ann

Gwyn in Kent

Gwyn in Kent Report 25 May 2006 12:47

Talking in general terms, ie not this case because I don't know details, I agree with Lisa that one should make an effort to shield the garden and respect a neighbour's right to NOT see naked flesh...... Whilst there is nothing wrong with naked bodies, one wouldn't necessarily want to view one when you have friends round for a barbecue, for example, or if children are out playing.

Harry

Harry Report 25 May 2006 12:47

There is a serious point here in an otherwise jokey thread. If a male went around his garden in the nude, rightly or wrongly, he would be prosecuted. Happy days

Apparently lots of people were so traumatised by the so-called naked rambler on his two trips from Lands End to John O'Groats that he has had numerous court appearances and lots of time in custody. My views - should have sought pschiatric help for going around unclothed purely because of the weather! But what a waste of the court's time and taxpayer's money. Christine
